Brady is guilty but won’t be punished

Removing the Tom Brady suspension was the correct thing to do, the legal thing to do. Tom Brady did beat the NFL, but not because Brady is innocent. Brady beat the NFL because Goodell mishandled the case. Brady is guilty, but legally the NFL screwed the pooch.

The court ruling (which you can read for yourself), says that the facts stand. Brady probably knew about the deflated balls. Brady did interfere with the investigation.

Yet, despite his guilt, Brady’s punishment goes away. The judge provides three reasons for removing the suspension:

(A) inadequate notice to Brady of both his potential discipline (four-game suspension) and his alleged misconduct; (B) denial of the opportunity for Brady to examine one of two lead investigators, namely NFL Executive Vice President and General Counsel Jeff Pash;
(C) denial of equal access to investigative files, including witness interview notes.

What does it mean?

(A) Gooddell gave Brady a 4 game suspension because deflating footballs is like using performance enhancing drugs. If you just said, “wait a minute shooting up with roids is totally different than deflating a football” then you get it. The judge said that Brady had no reason to suspect that deflating a ball would net a 4 game suspension like using roids would. By law, the NFL has to make sure that players know what counts as an infraction and what punishment comes with the infraction. The NFL didn’t do that.

(B) The NFL didn’t let Brady’s lawyers talk to Pash, who worked with Wells on the deflategate report.

(C) Goodell talked about the interview notes and how they helped him decide Brady was guilty. Then he refused to let Brady’s defense team see the notes.

So it looks like the NFL needs a good lawyer because they have no clue what they are doing.
